“Who Is There For You” Contest Official Rules
OPEN ONLY TO LEGAL RESIDENTS OF THE FIFTY UNITED STATES AND D.C., AGE 18 OR OLDER. NO PURCHASE NECESSARY. VOID WHERE PROHIBITED. U.S. LAW GOVERNS THIS CONTEST.
1. CONTEST PERIOD: The “Who Is There For You” Contest begins at 12:00 AM Eastern Time (ET) on July 14, 2008 and ends at 11:59 PM ET on October 21, 2008 (the “Entry Period”). Online entries must be submitted and received by Sponsor by 12:00 AM ET on October 21, 2008. Mailed entries must be postmarked by 12:00 AM ET on October 21, 2008 and received by October 28, 2008.
2. ELIGIBILITY: This contest is open only to persons who are 18 years of age or older and legal residents of one of the fifty United States and D.C. as of the date of entry. Employees of Advance America, Cash Advance Centers, Inc. (“Sponsor”), its subsidiaries, affiliates, distributors, and advertising, promotion and Internet agencies, and their immediate family (parents, children, siblings, spouses) and household members, are not eligible. Void where prohibited by law. In the event of a dispute regarding any online entry, the entry will be deemed made by the authorized account holder of the email address submitted at the time of entry (i.e., the natural person who is assigned to an email address by an Internet access provider, on-line service provider or other organization responsible for assigning email addresses for the domain associated with the submitted email address).
3. HOW TO ENTER: To enter online, access www.WhoIsThereForYou.com, and follow the on-screen entry instructions. To enter by mail, visit any participating Advance America retail location, pick up your official entry form, and mail your completed entry form, in a stamped envelope, to Erwin-Penland, Who Is There For You Contest, 125 E. Broad St., Greenville, SC 29601. Entrants will be required to identify a living person that the entrant wishes to nominate to receive a portion of the prize in the event the entrant is selected as a winner of the Grand Prize or Runner-Up Prize (see prize details in Section 5 below). Entrants will be required to complete and submit with each entry a story of no more than 1,000 words describing who has been there for them. Any entrant whose story is more than 1,000 words will be disqualified. The topic of the story must involve the entrant and another individual and reflect on how that person was there for the entrant in a time of need. For online entries, normal time rates, if any, charged by Internet service provider will apply. There is no limit on the number of entries per person, but each entry must be original and unique. Submission of duplicate stories will constitute grounds for disqualification. No purchase necessary. By participating in the Contest, each entrant certifies that the story submitted by the entrant is original, was written solely by the entrant, is an account of actual events involving the entrant and the individual he/she is nominating, and does not contain any material that would violate or infringe upon the rights of any third party, including without limitation copyrights, trademarks or rights of privacy or publicity. Entrant must obtain from each individual identified in the story consent to the same and to dissemination of the story as permitted hereunder. Stories must not contain any identifiable brand names. All entries and components thereof become the property of Sponsor and will not be returned.
4. SELECTION OF WINNERS: Potential winners will be selected by an advisory panel designated by Sponsor who will judge each entrant’s story on the basis of the following criteria, weighted equally: the story clearly demonstrates how someone was there for you in the time of need in a meaningful way and made a difference in your life; the story expresses the emotional aspects of the situation being described; the story has the ability to inspire others; and the story’s overall impression. The entrant who submitted the highest scoring story, based on the foregoing criteria, will be selected as Grand Prize winner. The entrant who submitted the next highest-scoring story will be selected as the Runner-Up Prize winner. In the event of a tie, the tied entrant with the highest score in the overall impression category will be deemed the winner. Winners will be selected on or about November 4, 2008 from among all eligible entries received. Winner must be living at the time of selection. Potential winners will be notified by mail, telephone and/or email, within approximately 14 days of selection. If potential winner cannot be reached within forty-eight (48) hours of initial notification attempt (no messages will be left on answering machines), he or she will be disqualified and the prize awarded to an alternate winner. Winners are subject to verification. Potential winners and their nominees may be required to complete and return to Sponsor an Affidavit of Eligibility (certifying, among other things, that the story is original, was written solely by the entrant, is an account of actual events involving the entrant and the person he/she is nominating and does not contain any material that would violate or infringe upon the rights of any third party, including without limitation copyrights, and an assignment of rights in and to all entry materials including the story), or the potential winners may be disqualified. If potential winner fails to respond to any notification attempt within the time period specified by Sponsor, or if any attempted notification or prize delivery is returned as undeliverable, or if the potential winner or nominee fails to complete and return any required affidavit or release within the specified time period, the potential winner may be disqualified and an alternate winner selected based on next highest score. Verification of potential winners’ eligibility may include, without limitation, a background investigation, and entrants agree to supply any authorizations or permission deemed necessary by Sponsor in connection with any such investigation.
5. PRIZES: Grand Prize. One (1) Grand Prize will be awarded. The Grand Prize consists of the sum of $25,000, which will be awarded to the Grand Prize winner, and the sum of $25,000, which will be awarded to the Grand Prize winner’s “Who Is There For You” nominee. The value of the Grand Prize is $50,000. Runner-Up Prize: One (1) Runner-Up Prize will be awarded. The Runner-Up Prize consists of the sum of $5,000, which will be awarded to the runner-up, and the sum of $5,000, which will be awarded to the runner up’s “Who Is There For You” nominee. The value of the Runner-Up Prize is $10,000. General Conditions: All prizes will be awarded if properly claimed. No substitution, or transfer of right to receive any prize permitted, except in the discretion of Sponsor, which reserves the right to substitute a prize of equal or greater value. Prizes consist only of items expressly specified in these Official Rules. All expenses or costs associated with the acceptance or use of any prize or any component thereof that are not expressly listed in these Guidelines are the responsibility of the winner. All federal, state, and local taxes on prize value, if applicable, are the sole responsibility of recipient. An IRS form 1099 will be issued if required by law. Total value of all prizes is $60,000.
6. GENERAL GUIDELINES: Entries may not contain material that Sponsor, in its sole discretion, deems inappropriate for public dissemination. Sponsor may, in its sole discretion, disqualify any entry that it deems to have violated any provision of the Official Rules and its decision in this regard is final. Entry constitutes a grant of permission to Sponsor and its parent companies, affiliates, subsidiaries, promotional partners, agents, and those they may designate from time to time, to use each entrant’s name, likeness, and city and state of residence and all entry materials (including the story), including without limitation, modifying, altering or amending the story, for purposes of trade, publicity or promotion, in all media whether now known or later developed, without any additional notice, consent or compensation (except where prohibited by law). Without limitation of the foregoing, by entering the Contest each entrant agrees that the Sponsor may display the entrant’s story online at Sponsor’s website for public viewing and/or comment. Sponsor may not display all stories online. Sponsor’s decision whether to display a particular story has no bearing on winner selection. Sponsor will have the right to edit stories, including without limitation correcting spelling and/or grammatical errors, prior to display, but any such corrections will not be taken into account in the winner selection process. Submission of any entry constitutes entrant’s consent to irrevocably assign to Sponsor any and all right to entry materials, including without limitation all intellectual property rights therein. If required by Sponsor, entrants must secure from any third parties identified in any story consent to the use of such story by Sponsor as permitted herein prior to awarding of prize. Sponsor is not responsible for incomplete, lost, late, damaged, illegible, delayed, corrupted, misdelivered or misdirected e-mail or mail, or for postage-due mail, or for any technical problems, malfunctions of any telephone lines, computer systems, servers, providers, hardware or software, lost or unavailable network connections, failed, incomplete, garbled or delayed computer transmission or any combination thereof, data loss or corruption, or human or technical errors of any kind. Sponsor assumes no responsibility for undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user's Internet service provider and/or e-mail client or for insufficient space in user's e-mail account to receive e-mail. Sponsor is not responsible for any liability for damage to any computer system resulting from participation in or accessing or downloading information in connection with this promotion. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROGRAM IS A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend this program should a virus, bugs, entrant fraud or misconduct, or other causes beyond the control of the Sponsor corrupt the administration, integrity, security or proper operation of the Contest. In the event of termination of the contest due to uncontrollable circumstances, a notice will be posted on-line and winners will be selected from all eligible entries received prior to the time of termination. Entry times will be determined using Sponsor’s computer, which will be the official clock for the Contest. All federal, state and local laws and regulations apply. By accepting prize, each prize recipient agrees to release and hold Sponsor, its affiliates, subsidiaries, distributors and agents, and each of their directors, officers, employees, successors and assigns, harmless from and against any and all claims and liability arising out of participation in the program or use of prize. Entrants assume all liability for any injury or damage caused, or claimed to be caused, by participation in this contest or use or redemption of any prize. Acceptance of prize constitutes permission for the Sponsor and its parent companies, affiliates, subsidiaries, agents and licensees to use recipient's name and/or likeness for purposes of advertising and trade and other commercial purposes without further consent or compensation, unless prohibited by law. Each online entry will be included in the drawing for the day during the Entry Period during which such entry was received and each mailed entry will be included in the drawing for the day the entry was postmarked. Odds of winning the prize depend on the number of eligible entries received for the applicable daily drawing. Names of potential winners may be posted on the sweepstakes website as winners are selected. Winners are subject to verification. Winners must be living at the time of selection. 1. SWEEPSTAKES PERIOD: The Who Is There For You MySpace Sweepstakes begins at 12:00 AM Eastern Time (ET) on July 14, 2008 and ends at 11:59 PM ET on October 21, 2008 (the “Entry Period”).
2. ELIGIBILITY: This sweepstakes is open only to legal residents of the United States (including D.C., but excluding New York and U.S. territories and possessions) who are 18 years of age or older and are members of MySpace as of the date of entry. Entrants must become a “friend” of Sponsor's Who Is There For You business page by clicking on the “become a friend” link found on Sponsor's My Space page in order to enter. You must be a member of MySpace in order to be able to become a “friend” of Sponsor's business page. Employees of Advance America, Cash Advance Centers, Inc. (“Sponsor”), its subsidiaries, affiliates, distributors, and advertising, promotion and Internet agencies, and their immediate family and household members, are not eligible. Void in New York, U.S. territories and possessions and where prohibited by law. In the event of a dispute regarding any entry, the entry will be deemed made by the authorized account holder of the ship-to address, name and email address submitted at the time of entry (i.e., the natural person who is assigned to an email address by an Internet access provider, on-line service provider or other organization responsible for assigning email addresses for the domain associated with the submitted email address).
3. HOW TO ENTER: To enter, access Advance America's Who Is There For You business page on MySpace.com, click on the link to become a “friend.” Normal time rates, if any, charged by Internet service provider will apply. Entries must be submitted and received by Sponsor by 11:59 PM ET on October 21, 2008. There is a limit of one sweepstakes entry per day, per person and per e-mail address. Limit one prize per person during the entry period. No purchase necessary.
4. SELECTION OF WINNERS: One (1) prize winner will be drawn for each week of the Entry Period. Each entry will be included in the drawing for the week during the Entry Period during which such entry was received. Odds of winning the prize depend on the number of eligible entries received for the applicable weekly drawing. For purposes of these Official Rules, a “week” shall mean the period of seven (7) consecutive days commencing at 12:00 AM ET on a Monday during the Entry Period, except with respect to the week commencing at 12:00 AM ET on October 20, 2008, which will conclude at 11:59 PM ET on October 21, 2008. Potential winner(s) will be notified by email or a notice posted on their MySpace page, within approximately three (3) days of selection. Names of potential winners may also be posted on the Sponsor's MySpace page. If a potential winner cannot be reached within forty-eight (48) hours of initial notification attempt, he or she will be disqualified and the prize awarded to an alternate winner. Winners are subject to verification. Winners must be living at time of selection. Potential winners may be required to complete and return to Sponsor an Affidavit of Eligibility/Release of Liability, and, if legally permissible, a Publicity Release within 10 days of attempted delivery of same. If potential winner fails to respond to any notification attempt within the time period specified by Sponsor, or if any attempted notification or prize delivery is returned as undeliverable, or if the potential winner fails to complete and return any required affidavit or release within the specified time period, the potential winner may be disqualified and an alternate winner selected via a second-chance drawing.
5. PRIZES: Each of the fifteen (15) prizes will consist of a $100.00 Visa® Gift Card. Total approximate retail value of all prizes is $1,500.00. Use of cards is subject to card terms and conditions. Expiration dates and other restrictions may apply. All prizes will be awarded if properly claimed. No substitution, cash redemption or transfer of right to receive any prize permitted, except in the discretion of Sponsor, which reserves the right to substitute a prize of equal or greater value. Prizes consist only of items expressly specified in these Official Rules. All expenses or costs associated with the acceptance or use of any prize or any component thereof that are not expressly listed in these Guidelines are the responsibility of the winner. All federal, state, and local taxes on prize value, if applicable, are the sole responsibility of recipient. Visa® Gift Cards are issued by MetaBank pursuant to a license from Visa U.S.A. Inc.
6. GENERAL GUIDELINES: Sponsor is not responsible for incomplete, lost, late, damaged, illegible, delayed, corrupted, misdelivered or misdirected e-mail, or for any technical problems, malfunctions of any telephone lines, computer systems, servers, providers, hardware or software, lost or unavailable network connections, failed, incomplete, garbled or delayed computer transmission or any combination thereof, data loss or corruption, or human or technical errors of any kind. Sponsor assumes no responsibility for undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user's Internet service provider and/or e-mail client or for insufficient space in user's e-mail account to receive e-mail. Sponsor is not responsible for any liability for damage to any computer system resulting from participation in or accessing or downloading information in connection with this promotion. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROGRAM IS A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process. Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend this program should a virus, bugs, entrant fraud or misconduct, or other causes beyond the reasonable control of the Sponsor corrupt the administration, integrity, security or proper operation of the sweepstakes. In the event of termination of the sweepstakes, a notice will be posted on-line and a second-chance random drawing to award one final prize will be conducted from among all eligible entries received prior to the time of termination. Entry times will be determined using Sponsor's computer, which will be the official clock for the sweepstakes. All federal, state and local laws and regulations apply. By accepting prize, each prize recipient agrees to release and hold Sponsor, its affiliates, subsidiaries, distributors and agents, and each of their directors, officers, employees, successors and assigns, harmless from and against any and all claims and liability arising out of participation in the program or use of the prize. Entrants assume all liability for any injury or damage caused, or claimed to be caused, by participation in this sweepstakes or use or redemption of any prize. Entry constitutes permission for the Sponsor and its parent companies, affiliates, subsidiaries, agents and licensees to use recipient's name and/or likeness for purposes of advertising and trade and other commercial purposes without further compensation, unless prohibited by law. All entries become the sole property of Sponsor and will not be returned. By participating in this promotion, entrants agree to be bound by the Official Rules and the decisions of Sponsor, which are final and binding in all respects. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the sweepstakes or in the announcement of the prize.
